Open letter to Honorable Ms.Louise Arbour, H C H R on the need of deployment of I H R M in Sri Lanka

Honored Madam,
As much as a husband cannot subdue his wife into submission of his wishes against her desire though a family is fully independent and with complete freedom to govern itself, Sri Lankan regime with Singhalese Buddhist supremacy mindset cannot subdue militarily the minority Tamils into submission of its wishes and foist its extremist policies on them with a specious claim of empowerment to unrestricted sovereignty or autarchy.
All the factors contributory to any communal rift or violence in Sri Lanka would dissipate, once the political grievances of the oppressed Tamils are redressed with a lasting solution to conform to the accepted international norms and standard.
As the local human rights institutions in Sri Lanka are prejudicial to the aspirations of the Tamil community, mere provision of technical assistance by the international human rights organizations would be nothing other than a white elephant.
Deployment of International Human Rights monitors in Sri Lanka is expedient, necessary and mandatory to crack down on the Human Rights violations as otherwise they would assume alarming proportions metamorphosing into abysmal cataclysm with the passage of time.
Under the subterfuge of emancipating the Tamils from the Tamil militants conferring the poisonous term of terrorists on them, the hawkish chauvinist regime tries all its best resorting to all tactics possible to bully the Tamil community into submission by being coerced into abiding by the Buddhist Singhalese chauvinism without grumbling over their subjugation. Tamils are being threatened with extrajudicial killings, torture, enforced disappearances, and arbitrary detentions, aerial bombardment, closures of highways, forced starvation and displacements besides denial of their other basic facilities expedient and necessary.
Because the Tamils who lived in peace and harmony in the Tamil territories under civil rule clamoured for their basic and fundamental political rights, Singhalese armed forces have crept into their territories displacing them in tens of thousands by force and army camps have mushroomed all over. Cultivation and fishing industry also have been either crippled or perished.
It has to be pointed out that, during the insurgencies of the Singhalese JVP extremists, the armed forces of the government never resorted to such tactics in the Singhalese areas, in consideration of the safety of the Singhalese civilians.
Just like the numerical strength of the majoritarian Singhalese community that could defeat any proposals of the Tamil community at any referendum, numerical strength of the Singhalese representatives in the legislative assembly, or a national government or any adhoc All Party Representatives Advisory Committee could defeat any proposals submitted by the Tamil representatives on behalf of the Tamil community
Under the patronage of regional and super powers, by being a pet in their hands, the Sri Lankan government roams around freely, and commits worst terrorism in Tamil homeland without being restrained, until the Tamil community is exterminated gradually but steadily.
In addition to their numerical strength, the Singhalese armed forces brazenly with impunity had already amassed sophisticated weaponry and armaments to satiety, together with multi-barrel guns, naval ships and war planes reserving funds enormously in the budget for war, in addition to other foreign aids from parties with vested interest, to crush only the Tamils in Sri Lanka.
Kfir (bomber plane) is one among the arsenal used by the Sri Lankan government to bomb Tamil villages. It has been used by Sri Lankan government since 1998, and it caused several Tamils to lose their lives. Kfir (bomber plane) is used by nations such as Israel, US, Ecuador, Colombia, and Sri Lanka. Sri Lankan government is well known for its human right violations, but still US approved Israel to sell this disastrous weapon to Sri Lanka, only to annihilate the Sri Lankan Tamil community.
India had provided military training to the top army brasses of Sri Lanka in Indian defence colleges and shared military and naval intelligence with the Sri Lankan armed forces, especially the Navy. And also it has transpired that India has gifted indigenously made Indra radars.
Regional and Super powers both overtly and covertly help the hawkish Singhalese government from time to time militarily, and provide military training to the Sri Lankan top army brasses and share military and naval intelligence with the Sri Lankan armed forces.
Before any embarkation on developmental ventures, as the Tamils are entitled to pursue their economic, social and cultural development and establish their self-autonomy, and self-identity within the framework of the United Nations' Charter, International humanitarian and human rights laws without any discrimination, peace process should be forged ahead from where it was interrupted in strict adherence to the Ceasefire agreement of 22/02/2002 under the supervision of the International peace monitors who are committed to their mission within the framework of the CFA, lest the gun culture burgeon furthermore irretrievably, gaining momentum.
As any freedom struggle or terrorism is a symptom of an underlying cause of an unjust system, aggression or denial of rights, they would automatically vanish on elimination of the root causes for the conflict.
It would be most appropriate and prudent to ensure before any embarkation on developmental, rehabilitation or resettlement ventures, the Tamils are empowered to live with their basic, fundamental and equal rights just like any Buddhist Singhalese, as they were before the advents of Colonial rulers in the year 1505 and the main theme of any peace process should be based on the basic, fundamental and equal rights of the Tamils as equality is the central principle of democracy.
Chauvinistic Singhalese who want to be with the absolute power obsessed with a mindset devoid of genuine will and desire sincerely to solve the problems, have never evinced any readiness or ability to negotiate to quench the aspirations of the Tamils for the last 59 years, since independence.
When the Tamils struggled since independence in 1948 for their basic and fundamental rights by ways of ahimsa, all their struggles were crushed by the Singhalese armed forces and the thuggish extremist Buddhist Singhalese precipitating several riots unleashed on the Tamils without confronting any retaliation.
The less squeamish, belligerent and oppressive, Buddhist Singhalese regimes have time and again successfully endeavoured to sweep the core issues for the ethnic conflict under carpet while confusing the world nations under a spell that the oppressed Tamils indulge in terrorism. After independence in 1948, somewhere only in 1970s, the Tamil militant group was in its embryonic stage and indulged in its retaliatory attacks in self-defence only since 1983.
Since 1983, over the last 24 years to date, in the war that ensued between the armed forces and the Tamil militants within the Tamil territories, churches, temples, schools, refugee camps, houses and business establishments were bombed and destroyed killing, wounding, maiming or mangling in hundreds including children while leaving behind children orphaned and men and women widowed besides the mass exodus of the Tamils to foreign countries.
It looks very unfortunate, unreasonable and unethical when Sri Lanka, a multi-ethnic and multi-religious country with a diverse and rich culture, has a constitution to impose the will of the majoritarian Buddhist Sinhalese on the Tamil minority.
Sri Lankan Constitution emphasizes that, only a Buddhist Sinhalese could be the Head of government and state, Buddhism could be the State religion, Singhalese could be the official language, colonization of Tamil areas by Singhalese could be done at State expense, and a contrived standardization procedure to enter higher education could be enforced to benefit the Sinhalese with the suppression of Tamil children who thrive on education.
And also, on the sly the past historical records or the archaeological evidences of the country are being reportedly tampered with surreptitious interpolations to be advantageous to the Sinhalese community under the powerful iniquitous Buddhist Singhalese rule.
By virtue of the Constitution in effect and force, even the judicature or the judicial system in Sri Lanka is of a bias favourable to the Buddhist Singhalese extremism.
Joint Mechanism formulated on humanitarian grounds to dispel the hardships of the Tsunami victims in the North-East had been abrogated by the Sri Lankan judicature.
Governments one after the other had tantalized the Tamils with false hopes and assurances in a desultory fashion from time to time with tiring and boring treadmill of pacts, accords, conferences, talks, agreements, memorandums, appointments of committees etc,etc, which all turned into a complete fiasco, so far. After the Independence in 1948, former Prime Minister S.W.R.D.Bandaranayake from SLFP prioritized Singhalese only policy of 1956 and captured power defeating the U.N.P. Bandaranayke- S.J.V.Chelvanayagam Pact of 1957 was abrogated because of the UNP protests. Dudley Senanayake - S.J.V.Chelvanayagam Pact of 1965 was abrogated because of the SLFP protest. The Republican Constitution of 1972, robbed the minorities of even the scanty safeguards against discrimination provided under Section 29 of the Soulbury Constitution, introduced at independence in 1948. Indo-Lanka Accord of 1987 was abrogated by the National Singhalese protests.
Obsessed with Communal bias if the Singhalese community cannot share powers with the Tamil community, system should be changed, loosened up, or broken off with the secession of Tamil territories from the rest of Sri Lanka as it is the only alternative.
In Sri Lanka, which is 65,610 sq.km approximately, we can have two States, to conform to the accepted International norms and standard, without contravening the United Nations Charter. A few UN Member States actually smaller than either the future Sinhalese Sri Lanka approx. 46,777 sq.km. Or the Thamileelam approx. 18,833 sq.km (in order of Area) are as follows: Fiji, Kuwait, Swaziland, East Timor, Vanuatu, Qatar, and Gambia the, Jamaica, Lebanon, Cyprus, Brunei, Cape Verde, Luxembourg, Comoros, Mauritius, Singapore, Atoll of Atafu and so on.
International communities have recognized the existences and independence of UN Member States like Israel, Bangladesh and so on in the past or East Timor from Indonesia in year 2002, State of Eritrea from Ethiopia on 24 May 1993, Atoll of Atafu the last colony of New Zealand with not even 1500 people in March 2006, and Republic of Montenegro from Serbia and Montenegro on 3 June 2006.
U.S. May Bypass the U.N. for Kosovo Independence

UNITED NATIONS, July 13 — Declaring the need for a timely decision on Kosovo’s desire for independence from Serbia, the United States threatened Friday to seek a solution outside the United Nations if Russia persisted in blocking Security Council action.

| This is a classic example of defeating yourself and the people behind you. JRJ thought that he he should bring a constitution which will not permit any Tamil party to be the leading opposition and he achieved it, may his soul not rest anywhere! He thought as he always should do something better than SWRD, to get another ladslide victory, in the process letting all the peace loving Sinhalese down. thus he created the current monster of a constitution even Ranil cannot resist! JRJ knew the negatives of the people and not the positives. Admitting that JRJ diid author the current escalation, there is no reason why the current outfit should not get away from it. There again JRJ (Thambi Mudiansellage- sorry for the reference.) features! We know that MR wants to solve this problems. UNP wants a hand in it. But the JVP wants to score a non-existent nationilstic plus point on it. The mutual distrust between the two major parties prevent such a thing happening. What would then be the end result of it? JVP, hitherto has been surviving on verbosity might get a chance in the next election if there is one, and that would be the end of the country. |
